AND EVER SINCE I'VE BEEN MAYOR THE PAST TWO AND A HALF, ALMOST THREE YEARS, I GUESS LARISSA'S BEEN AN ABSOLUTE PLEASURE TO WORK WITH.

I COULDN'T HAVE ASKED FOR SOMEONE TO TO HELP GUIDE ME AS I FIRST STARTED ON THIS JOURNEY.

AND WE'RE GOING TO SHE'S GOING TO BE DEEPLY MISSED IN THIS IN THIS CITY.

SO ANYWAY, I HAVE A PROCLAMATION FOR YOU.

WHEREAS LARISSA PHILPOTT BROWN HAS DEMONSTRATED OUTSTANDING DEDICATION AND COMMITMENT TO THE CITY OF NACOGDOCHES FOR A REMARKABLE 25 YEARS BEGINNING ON AUGUST 28TH, 2000 AND ENDING OCTOBER 23RD, 2025.

AND WHEREAS THROUGHOUT HER TENURE IN NACOGDOCHES, LARISSA HAS CONSISTENTLY EXEMPLIFIED THE VALUES OF INTEGRITY, TRANSPARENCY, ACCOUNTABILITY, EFFICIENCY, AND RESPONSIVENESS AND HAS BEEN AN INSPIRATION TO COLLEAGUES AND COMMUNITY MEMBERS ALIKE.

AND WHEREAS LARISSA'S LEADERSHIP ROLES AS CITY PLANNER, DIRECTOR OF MUNICIPAL SERVICES AND EXECUTIVE DIRECTOR OF ECONOMIC DEVELOPMENT HAVE MADE SIGNIFICANT AND LASTING CONTRIBUTIONS IN MENTORING NEW EMPLOYEES, LEADING KEY PROJECTS, FOSTERING A POSITIVE WORK ENVIRONMENT, AND DEMONSTRATING OUTSTANDING PROBLEM SOLVING SKILLS.

AND WHEREAS MARISSA'S SERVICE WITH COMMUNITY ORGANIZATIONS SUCH AS THE ECONOMIC DEVELOPMENT CORPORATION, STEPHEN F AUSTIN STATE UNIVERSITY ALUMNI ASSOCIATION, NACOGDOCHES ROTARY CLUB, NACOGDOCHES MEDICAL CENTER, CASA OF DEEP EAST TEXAS, AND ALLIANCE FOR I-69 TEXAS CONTINUE TO BE INSTRUMENTAL IN THE GROWTH AND SUCCESS OF OUR GREAT CITY.

AND WHEREAS HER TIRELESS EFFORTS, POSITIVE ATTITUDE, AND PROFESSIONAL EXCELLENCE HAVE LEFT A LASTING LEGACY AND SET A HIGH STANDARD FOR ALL OF THOSE WHO HAVE HAD THE PRIVILEGE TO WORK ALONGSIDE HER.

I LIVE ON LAKE NACOGDOCHES IN A SMALL COVE CALLED PINE COVE ON THE WEST SIDE OF THE LAKE. WE ARE NEAR THE POWER LINES CROSSING AT THE OPPOSITE END OF THE EAST PARK AND WEST PARK BOAT LAUNCHES. I'M HERE TODAY REPRESENTING MYSELF AND SOME OF MY NEIGHBORS IN PINE COVE. WE'RE HAVING A PROBLEM WITH JET SKIS, SKI BOATS AND FISHING BOATS THAT ARE ENTERING AND EXITING THE COVE AT HIGH RATES OF SPEED, PARTICULARLY JET SKIS ENTERING AT EXTREME SPEEDS AND PERFORMING CIRCLES IN ACROBATIC TRICKS. THIS CAUSES LARGE WAKES AND ALSO CAUSES UNFAVORABLE NOISE THAT DISTURBS THE OTHERWISE PEACEFUL ENVIRONMENT.

WE FEEL THIS IS HIGHLY DANGEROUS FOR SWIMMERS, PADDLE BOATERS AND KAYAKS.

I HAVE PERSONALLY EXPERIENCED THIS BEHAVIOR ON NUMEROUS OCCASIONS WHILE SWIMMING IN THE WATER NEAR OUR BOAT DOCK WITH MY FIVE GRANDCHILDREN, I'VE HAD TO WAVE DOWN JET SKIERS AND BOATERS TRAVELING AT HIGH SPEED TO GET THEIR ATTENTION OF OUR PRESENCE IN THE WATER.

IT'S A VERY SCARY SITUATION.

THE LARGE WAVES CAUSED BY THESE BOATERS ARE CAUSING DAMAGE TO OUR PERSONAL DOCKS AND BOATS THAT ARE TIED OFF.

IT IS ALSO CONTRIBUTING TO OUR SHORELINE EROSION.

OUR COVE IS PERFECT FOR FISHERMEN WANTING QUIET, STILL WATERS. WE HAVE AN ABUNDANCE OF RESPECTFUL MEN AND WOMEN WHO FISH HERE ON A DAILY BASIS. WE WELCOME THEM.

I CALL TO YOUR ATTENTION THE RECENT ADDITION OF THE NACOGDOCHES RANCH DEVELOPMENT ON COUNTY ROAD 779, AND THE NEW CAMPGROUND FACILITY BEING BUILT NOW ON HIGHWAY 225.

THIS WILL PROBABLY CAUSE A SIGNIFICANT INCREASE IN WATER ACTIVITY.

WE WELCOME THEM. WE JUST WANT A SAFE ENVIRONMENT FOR ALL WHO ENJOY OUR BEAUTIFUL LAKE TODAY. MY NEIGHBORS AND I REQUEST A NO WAKE SAFETY BUOY BE PLACED NEAR THE ENTRANCE OF OUR COVE. THIS WILL SLOW DOWN THE WATER TRAFFIC AND POSSIBLY PREVENT ANY INJURY OR DEATH TO PERSONS IN THE LAKE.

IT WILL ALSO PREVENT FUTURE PERSONAL PROPERTY DAMAGE AS WELL.

PINE COVE IS APPROXIMATELY 220 YARDS LONG.

IT DEAD ENDS INTO A LARGE BULKHEAD.

IT'S ABOUT 75 YARDS WIDE AND AN AVERAGE DEPTH IS UNDER EIGHT FEET.

AS A MOTHER, I HAVE STRONG INSTINCTS THAT I HAVE LEARNED NOT TO IGNORE.

I FEEL LIKE SOMETHING BAD IS GOING TO HAPPEN IN THE FUTURE IF WE DO NOT ADDRESS THIS NOW.

YOU WILL RECALL BACK IN APRIL OF THIS YEAR, WE HAD A WORKSHOP WHERE WE DISCUSSED A POTENTIAL ISSUE REGARDING OUR NOISE ORDINANCE AS IT CURRENTLY EXISTS, AND THE MAIN ISSUE IS THAT THERE ARE TWO SEPARATE PROVISIONS, ONE UNDER CHAPTER 34 AND ONE UNDER CHAPTER 118.

WHAT THE PROPOSED AMENDMENT ATTEMPTS TO DO IS TO ELIMINATE THOSE PROVISIONS IN 118 OR AT LEAST TO MOVE THOSE ACTIONABLE ITEMS OVER UNDER.

CHAPTER 34 UNDER ENFORCEMENT.

SINCE THAT MATTER INVOLVED A ZONING AMENDMENT, IT HAD TO GO BEFORE THE PLANNING AND ZONING COMMITTEE AND IT THE PLANNING AND ZONING COMMISSION, EXCUSE ME MET ON OCTOBER 13TH, 2025.

FOLLOWING THE PUBLIC HEARING AND DISCUSSION, THE COMMISSION TOOK NO ACTION ON THE ITEM AND WISHED TO HAVE ADDITIONAL TIME TO DISCUSS IT.

MATTER OF FACT, THE REST OF THIS IS GOING TO BE PUBLIC HEARINGS. DISCUSS AND CONSIDER ACTION ON ANNEXATION CASE A ANNEX 2020 5-01.

REGARDING THE VOLUNTARY ANNEXATION OF TWO PARCELS OF LAND.

APPROXIMATELY 3.04 ACRES, PLUS OR MINUS IN SIZE, MORE PARTICULARLY DESCRIBED BY NACOGDOCHES CENTRAL APPRAISAL DISTRICT PARCELS 100001678781263 AND GENERALLY LOCATED TO THE NORTH AND SOUTH OF 2000 NORTHEAST STALLINGS DRIVE.

MR.. GOOD AFTERNOON, MAYOR, CITY COUNCIL JUANPABLOT CITY PLANNER.

SO THIS REQUEST IS A VOLUNTARY ANNEXATION SUBMITTED BY THE REGENTS ACADEMY OF NACOGDOCHES. THE ANNEXATION AREA INCLUDES TWO PARCELS TOTALING APPROXIMATELY 3.4 ACRES, LOCATED NORTH AND SOUTH OF THE EXISTING REGENTS ACADEMY CAMPUS.

THE NORTH PARCEL IS PLANNED FOR A SCHOOL GYMNASIUM, AND THE SOUTH PARCEL IS PARTIALLY WITHIN THE CITY LIMITS.

ANNEXING THE REMAINING PORTION WILL ALIGN THE CITY LIMITS AND ZONING BOUNDARIES WITH THE PROPERTY LINES. IF THIS REQUEST IS APPROVED, THE PROPERTY WILL AUTOMATICALLY BE ZONED AGRICULTURAL. THERE WILL BE A SUBSEQUENT ZONING CASE ON TONIGHT'S AGENDA REQUESTING A CHANGE TO B2 GENERAL BUSINESS.

THIS SLIDE SUMMARIZES THE FRAMEWORK THAT GOVERNS THE VOLUNTARY ANNEXATIONS IN TEXAS UNDER CHAPTER 43, SUBCHAPTER C THREE.

THIS ANNEXATION QUALIFIES AS AN ANNEXATION OF AREA ON REQUEST OF OWNERS, MEANING IT'S COMPLETELY VOLUNTARY AND INITIATED BY THE PROPERTY OWNER AS SHOWN HERE. WE'VE MET ALL THE REQUIRED PROCEDURAL STEPS.

THE PROPERTY IS ENTIRELY LIES WITHIN THE CITY'S ETJ.

REGENTS ACADEMY SUBMITTED A FORMAL PETITION FOR ANNEXATION.

A MUNICIPAL SERVICE AGREEMENT WAS PREPARED OUTLINING HOW CITY SERVICES WILL BE PROVIDED UPON ANNEXATION. NOTICES WERE SENT TO AFFECTED PUBLIC ENTITIES AND UTILITIES, AND PUBLIC HEARING NOTICES WERE PUBLISHED, MAILED AND POSTED ONLINE IN ACCORDANCE WITH THE STATE LAW. FINALLY, THE ORDINANCE MUST BE ADOPTED WITHIN 90 DAYS, INITIATING ANNEXATION PROCESS THIS ANNEXATION IS EXPECTED TO HAVE A NEUTRAL TO POSITIVE PHYSICAL IMPACT FOR THE CITY.

REGENTS ACADEMY IS A TAX EXEMPT INSTITUTION, SO THERE WILL BE NO IMMEDIATE INCREASE IN AD VALOREM TAX REVENUE. HOWEVER, THE ANNEXATION SUPPORTS THEIR CONTINUED CAMPUS EXPANSION AND ENSURES THAT FUTURE IMPROVEMENTS AND UTILITY SERVICES ARE WITHIN CITY JURISDICTION. THE COST OF EXCEEDING EXTENDING MUNICIPAL SERVICES HAS BEEN EVALUATED THROUGH THE SERVICE PLAN AND CAN BE ABSORBED WITH EXISTING DEPARTMENT BUDGETS AND STAFF. TO SUMMARIZE, REGENTS ACADEMY'S MAIN CAMPUS WAS ORIGINALLY ANNEXED IN 2008, AND THAT ANNEXATION INCLUDED EXTENSION OF SEWER SERVICES ALONG STALLINGS DRIVE.

THE CITY ALREADY PROVIDES SEVERAL ESSENTIAL SERVICES TO THIS AREA, INCLUDING FIRE AND RESCUE, LIBRARY, RECREATION, WATER, SEWER AND SOLID WASTE.

WHILE LAW ENFORCEMENT, ANIMAL CONTROL AND STREET MAINTENANCE ARE STILL PROVIDED BY THE COUNTY.

WITH THE PROPOSED ANNEXATION, THE CITY WILL OFFICIALLY EXTEND FULL MUNICIPAL SERVICES SUCH AS POLICE CODE ENFORCEMENT, BUILDING INSPECTION AND STREET MAINTENANCE TO THESE PARCELS.
