SO WAY BACK IN 2010, THEY WANTED YOU ALL AND THE CITIZENS TO KNOW THAT THEY WERE DOING EVERYTHING RIGHT, THAT THEY ACHIEVED THE GOLD STANDARD, THAT THAT BEST PRACTICES RAN THROUGHOUT THE DEPARTMENT. SO THEY ACHIEVED IT IN 2010. AND EVERY IT'S GOOD FOR FOUR YEARS. EVERY FOUR YEARS YOU HAVE TO GET REACCREDITED. CHAPTER 380 ECONOMIC DEVELOPMENT PROGRAM AND AUTHORIZING AN AGREEMENT BY AND BETWEEN THE CITY OF NACOGDOCHES AND ICON CINEMA NACOGDOCHES, LLC REGARDING THE RENOVATION AND OPERATION OF A MOVIE THEATER AT 3801 NORTH STREET. MR. MAYOR, MEMBERS OF THE COUNCIL. JERRY BAKER, CITY ATTORNEY. THE. THE TERMS OF THE 380 AGREEMENT THAT'S IN FRONT OF YOU FOR CONSIDERATION IS THE STANDARD 380 AGREEMENT THAT YOU'VE SEEN BEFORE THAT'S BEEN PRESENTED. IT SETS FORTH THE REQUIREMENTS THAT THE DEVELOPER WOULD HAVE, AND IN THIS CASE, RENOVATING THIS PARTICULAR PIECE OF PROPERTY, INCLUDING THE AMOUNTS THAT WILL BE. SPENT OR EXPENDED FOR THE CONSTRUCTION OR RENOVATIONS, AS WELL AS THE ADDITION OF ANY PERSON PERSONALLY, PROPERTY, IN THIS CASE, FURNITURE AND EQUIPMENT, INCLUDING AS WELL. AND UNLIKE SOME OF THE OTHER 380 AGREEMENTS YOU'VE SEEN IN THE PAST, THIS IS A REIMBURSEMENT OF NOT OF AD VALOREM TAX, BUT OF SALES TAX.

IT STILL REQUIRES THE THE PROPERTY OWNER TO PAY THOSE AD VALOREM TAXES TIMELY, AS WELL AS PROVIDE THE COMPLIANCE REPORT AS SET FORTH IN THE 380 AGREEMENT BY THE END OF JANUARY 31ST 31ST, IN ORDER TO GET THOSE REIMBURSEMENTS.
